GENERAL CONTRACTING CONDITIONS
The following is the contractual document that will govern the contracting of products through the website www.enjoy.cat owned by the company ENJOYCAT BCN SL with CIF B67574939, (hereinafter "ENJOY.CAT"). Acceptance of this document means that the user:
a) Has read, understands and understands what is set out here.
b) That he is a person with sufficient capacity to contract.
c) That it assumes all the obligations provided here.
These conditions will be valid indefinitely and will be applicable to all contracts made through the website www.enjoy.cat
ENJOY.CAT reserves the right to unilaterally modify these General Conditions, without this being able to affect the goods or promotions that were acquired prior to the modification.
IMPORTANT: All users of the website, regardless of their status as visitors or registered users, are subject to the Legal Notice. In addition, all customers, before giving their consent, will declare that they have read and know these conditions, to which they will be subject and will expressly accept their terms, in order to consider the purchase operation formalized.
1. Products for sale.
ENJOY.CAT offers gourmet products through an e-commerce web platform. This platform is the only support through which the customer can purchase these items.
ENJOY.CAT will specify the characteristics of the products for sale, as the producer has supplied them or made them available to consumers.
ENJOY.CAT will inform the customer of the sale price to the public of each product, expressed in euros (€), with the applicable taxes included.
ENJOY.CAT reserves the right to add and remove any product or service from the virtual store, at any time. Unless otherwise provided, the newly incorporated products shall be subject to the provisions of the general conditions of contract from that time. The customer must keep in mind that some of the suggested products have a seasonal offer and / or are of very limited production, which is why there is the possibility that at the time of processing an order, they are not available. In this case, ENJOY.CAT will inform the customer so that he is aware of it.
IMPORTANT: The sale of some products that are offered through the web, is only allowed to people over 18 years.
2. Purchase procedure.
ENJOY.CAT makes available to the customer the following sequential purchase procedure in order to formalize the operation:
1. The customer will be able to choose the products he wants and will be able to add them to his basket of purchase so much from the file of the product, as from other places enabled to the object. The customer will be able to consult at any time the state of his basket, obtaining the information of the products chosen, his price and the accumulated total of intention of purchase. At this stage of the process, the customer is free to add or remove the products they want from their basket.
2. Once the customer has started the purchase procedure using the corresponding option, he will be shown a list with all the products included in his order. You will also be told the unit price and the total value of your basket, including transportation.
At this stage of the process, the customer will still be able to add or remove products from their basket, at their free choice.
3. Once the products you want to purchase have been defined, the customer is free to proceed to the checkout page by clicking on the "Finish purchase" button. You can easily consult the general conditions of contract.
4. The customer will then report the delivery address, billing details and payment details. Using a diagram, the customer will know at all times how high the purchase process is and the system will show at all times the final amount to be paid.
If the customer decides at this time that the information provided is correct and complete, he will be asked to give his consent to complete the purchase transaction. Once this consent has been given, the order cannot be modified.
5. At this time, the customer will formalize the payment of the operation through the use of the bank payment gateway. ENJOY.CAT reserves the right to change the gateway and payment systems according to your needs, at any time and without notice.
6. Once all these steps have been completed, the customer will receive a confirmation of their purchase by e-mail and immediately.
3. Form of payment.
ENJOY.CAT only accepts payment by credit card (Visa and Mastercard) by virtual gateway.
The customer data will be encrypted according to SSL (Secure Socket Layer) protocols, thus ensuring their security and confidentiality.
4. Transport and delivery.
ENJOY.CAT will manage national shipments to the shipping address provided by the customer during the purchase process. No shipments will be made to post offices in any country in the world. Shipping costs will be calculated based on the weight of the order.
ENJOY.CAT will select the transport agency that suits you best at any given time and for each destination to the object to obtain a service as efficient and reliable as possible and will issue the order within 48-72 hours (maximum) following receipt of the same (except on weekends or public holidays that will do so on the first working day following) and then if the payment is confirmed, as long as the products are available and there are no circumstances of force majeure that prevent it. The selected transport agency will deliver the order within the deadline it has established according to the destination and type of service used. In all cases, once the goods have been delivered to the carrier, the system will send the customer an email with a code that will allow them to track the shipment via the carrier's website. ENJOY.CAT will not be responsible for delays in delivery caused exclusively by causes attributable to the transport agency or to unforeseeable and uncontrollable factors that it does not have the duty to bear.
As a general rule, transport agencies make several attempts to deliver the goods. If this is finally returned and the various delivery attempts are proven, the customer will have no right to a refund of the amount of their purchase. In any case, ENJOY.CAT will never manage the forwarding of the goods.
5. Withdrawal and return of an order.
In the event that one or more products arrive damaged as a result of transport, the consignee must state this in writing on the delivery note given to him by the carrier at the time of receipt of the shipment, accompanied by his signature. . ENJOY.CAT must then communicate this in writing, within a maximum period of fourteen working days from the date of receipt, explaining the facts in detail. The recipient must keep the damaged product (s) unopened in its original packaging, avoiding any manipulation, alteration or use. Once the appropriate procedures and checks have been carried out, and within a maximum period of thirty days from the date of communication, ENJOY.CAT will reimburse the money for the damaged products using the form of payment used at the time of making the purchase. Once the money has been reimbursed, ENJOY.CAT reserves the right to claim the damaged products (bearing the costs of returning them).
If the products received differ from the original order, the customer must notify ENJOY.CAT in writing, within a maximum of seven working days from the date of receipt. The recipient must keep the product / s object of claim without opening, inside its original packaging, avoiding any type of manipulation, alteration or use. Once the appropriate procedures and checks have been made, and within a maximum period of thirty days from the date of communication, ENJOY.CAT will reimburse the money for the erroneous products using the form of payment used at the time of making. the purchase. Once the money has been reimbursed, ENJOY.CAT reserves the right to claim the erroneous products (bearing the costs of returning them).
If for any reason other than the above, the customer decides to return any product, except the products considered special, will have fourteen working days from the date of receipt of the shipment. The customer must notify ENJOY.CAT in advance, in writing, within the indicated period. The recipient must keep the product / s unopened, inside its original packaging, avoiding any kind of manipulation, alteration or use. The customer must return this / these product (s) in perfect condition, bearing the costs of both the first shipment and the return (which must be managed directly), as well as customs costs, if any. . Once received / if the appropriate checks have been made, ENJOY.CAT will refund your amount by transfer to the credit card used at the time of purchase, within a maximum period of thirty days from the date of reception of the product / s in its facilities.
All products will be delivered with the correct expiration date and no changes due to expiration will be accepted. All products will be indicated with the expiration of each and is indicated on the product sheet.

The right of resolution (withdrawal) is excluded in those cases where due to the nature of the content of the services it is impossible to carry it out, without prejudice to the claim for damages suffered or when the goods returned to the warehouse or its packaging are not complete and / or in perfect condition.
6. Applicable Legislation and Jurisdiction.
The preparation, application and interpretation of these General Conditions of Contract by any arbitration or judicial body are subject to the regulations established in the Spanish legal system.
The parties undertake to try to resolve any disputes that may arise before an arbitral tribunal in the province of Barcelona that may issue a binding award.
If the matter is taken to court, for the resolution of any dispute between the client and ENJOY.CAT , the parties agree to submit the resolution of the same to the courts and tribunals of Barcelona, waiving any other general or special jurisdiction that could correspond to them.
In international traffic, the parties expressly submit to the Spanish legal system regarding the application and interpretation of these General Conditions and to the Spanish arbitrators and judicial bodies of the city of Barcelona as a jurisdiction to resolve possible legal disputes. . This jurisdiction is established without prejudice to the application of Regulation 44/2001 EC and other international standards signed by the Spanish State in matters of jurisdiction and laws applicable to consumption in international trade.
